Following standard terms and conditions governs how we process and settle your purchases placed through Fonden Roskilde Festival’s website.

At shop.roskilde-festival.dk we sell Fonden Roskilde Festival goods, rental products and other services and Fonden Roskilde Festival Partner Volt ApS goods, rental products, and other services.

Fonden Roskilde Festival products are goods, rental products, and other services that we sell on shop.roskilde-festival.dk unless it is identified as Fonden Roskilde Festival Partner Volt ApS goods, rental products, and other services on our website. Fonden Roskilde Festival Partner Volt ApS products are goods, rental products, and other services that we offer on shop.roskilde-festival.dk and identify as partner products.

1. Formation of contract and delivery of goods

1.1. By placing an order, you confirm to purchase for private purposes exclusively.

1.2. When you order Fonden Roskilde Festival goods you enter a contract agreement with Fonden Roskilde Festival, and when you order Fonden Roskilde Festival Partner Volt ApS goods you enter a contract agreement with the respective Fonden Roskilde Festival Partner Volt ApS. Fonden Roskilde Festival Partner Volt ApS is specifically identified on each product details page.

1.3. Once you have submitted your order, we will send you an e-mail acknowledgement of your order. This confirms that we have received your order, but it is not an acceptance of your order. A binding contract is formed when the order has been delivered.

1.4. We are not required to accept your order, and we may modify, reject, or cancel your order for any reason, including but not limited to one of the following reasons:

• The product you ordered being unavailable from stock. In that event, we will let you know as soon as we can, and where payment has already been made, we will make a refund to your payment method without undue delay.
• If we are unable to obtain authorization for your payment.
• The identification of a pricing or product description error.
• We reasonably believe that you may have the intent to resell the product; or
• You are not complying with these Terms and Conditions.

1.5. After your order has been accepted you will receive a voucher. The voucher will be sent in an electronical form, exclusively, and gives you the right to receive the product, rental product, or other services you have purchased. The voucher can only be used once.

1.6. Where time periods are expressed by working days, a working day means all the days between Monday - Friday inclusive, but not Danish public holidays.

2. Prices and shipping costs

2.1. All prices on the shop.roskilde-festival.dk are given in DKK. The prices given on the website on the date the order is placed shall apply. The stated prices are final prices (totals) including value added tax (VAT) at the applicable statutory rate and any additional costs that may arise. All items remain our property or the property of the Fonden Roskilde Festival Partner Volt ApS, as the case may be, until full payment of the purchase price.

2.2. Fonden Roskilde Festival and Fonden Roskilde Festival Partner Volt ApS do not offer home shipping or shipping to other delivery destinations, other than to the shipping destination stated in section 2.03 and 2.04.

2.3. All Fonden Roskilde Festival products, rentals, and other services will only be delivered to and available for pickup at three dedicated pickup points at Roskilde Festival.

2.4. All Fonden Roskilde Festival Partner Volt ApS products, rentals and other services will be delivered to and available for pickup at dedicated pickup points Roskilde Festival.

2.5. Delivery to and pickup at Roskilde Festival incurs no additional charge to your order.

2.6. If you decide to cancel after you have taken possession of the products, we will reimburse you when the full order is returned (see section 4 and 6). We will not refund costs associated with return delivery.

3. Payment

3.1. We accept the following payment methods: debit and credit card, and payment through Mobilepay, Apple Pay and Google Pay. We reserve the right to not accept certain payment methods for a given order and to refer to other payment methods.

3.2. For orders on products, your card will be charged when we have acknowledged your order.

3.3. For orders on service(s) i.e., rental goods etc., your card will be charged when we have acknowledged your order. Please note that we require a deposit for rental goods. The deposit amount will appear at the product page. The deposit will be returned to you 21 banking days after the rented product has been handed back to us in the same method the deposit is drawn. Please note that you may lose the right to your deposit (see section 8). 

4. Your statutory right to cancel in respect of Fonden Roskilde Festival products

4.1. You have the following cancellation rights when your order from the site

4.1.1. You are entitled to terminate your contract (your whole order) or part of your contract (only certain products from your order) if you so wish, provided that you exercise your right no longer than 14 days after the day on which delivery of the products in question has been made. Returns must be in original condition, unworn/unused with original tags and labels.

4.1.2. In the case of multiple goods ordered in one order and delivered separately, you may exercise your right no longer than 14 days after you or a third party indicated by you, acquires physical possession of the last item.  

4.1.3. Your right to return products does not apply to perishable goods which shall include, but not limited to, foods, drinks, and other products that are liable to deteriorate or expire rapidly, and goods made to your specification, that have been clearly personalized. That applies to goods which are not suitable for return due to health protection or hygiene reasons as well.

4.1.4. To exercise your right to cancel you must inform us of your decision to withdraw from the contract by making a clear statement setting out your decision to withdraw from the contract. Your statement must include details of your name, address, details of the order you wish to cancel, email address, and where available, your phone number.

4.1.5. You can cancel by contacting our customer services team on the contact details in section 18.

4.1.6. If you decide to cancel in accordance with section 4.1.1, after you have taken possession of the product, you are to return the products to us within 30 days of such cancellation. We will not refund costs associated with return delivery.

4.1.7. We may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of unnecessary handling by you.

4.1.8. We will make reimbursement no later than 14 days after the day we receive back from you any goods supplied unless documentation for returning has been submitted (for example receipt from the post office).

4.2. You may also cancel your contract if the products are damaged, faulty, or not as described, in which case we will refund the costs of returning the goods. We will only refund the costs of returning the goods provided you use a delivery method we have offered. In that case, please contact the customer service team who will provide further information. We will not refund supplementary costs arising from you choosing a type of delivery other than the one we have offered. Please see clause 10 for further information.

5. Your statutory right to cancel in respect of Fonden Roskilde Festival rental products and other services

5.1. You have the following cancellation rights when you order from the site

5.1.1. You are entitled to terminate your contract (the whole service) or part of your contract (only certain services) if you so wish, provided that you exercise your right no longer than 14 days after the day of the conclusion of the contract. i.e., when we have accepted your order.

5.1.2. Your right to terminate your contract within 14 days after the day of the conclusion of the contract does not apply following the initiation of the renting period.

5.1.3. To exercise your right to cancel you must inform us of your decision to withdraw from the contract by a clear statement setting out your decision to withdraw from the contract. Your statement must include details of your name, address, details of the order you wish to cancel, email address, and where available, your phone number.

5.1.4. You can cancel by contacting our customer services team on the contact details in section 18.

5.1.5. We will make reimbursement no later than 14 days after the day we receive a clear statement of cancellation.

5.2. You may also cancel your contract if the products provided in the services are damaged, faulty, or not as described. Please see clause 10 for further information.

6. Your statutory right to cancel in respect of Fonden Roskilde Festival Partner Volt ApS products

6.1. You have the following cancellation rights when you order from the site

6.1.1. You are entitled to terminate your contract (your whole order) or part of your contract (only certain products from the order) if you so wish, provided that you exercise your right no longer than 14 days after the day on which delivery of the products in question has been made. 7. Your statutory right to cancel in respect of Fonden Roskilde Festival Partner Volt ApS rental products and other services

7.1. You have the following cancellation rights when your order from the site

7.1. You are entitled to terminate your contract (the whole service) or part of your contract (only certain services) if you so wish, provided that you exercise your right no longer than 14 days after the day of the conclusion of the contract. i.e., when we have accepted your order.

7.2. Your right to terminate your contract within 14 days after the day of the conclusion of the contract does not apply following the initiation of the renting period.

7.3. Your right to return does not apply to perishable goods or goods that expire quickly, which include, but are not limited to, food, beverages and other goods that can deteriorate, expire or become obsolete quickly even in relation to sales value, and goods manufactured after your specification that is clearly personalized. This also applies to goods that are not suitable for return for health or hygiene reasons.

7.4. To exercise your right to cancel you must inform us of your decision to withdraw from the contract by a clear statement setting out your decision to withdraw from the contract. Your statement must include details of your name, address, details of the order you wish to cancel, email address, and where available, your phone number.

7.5. You can cancel by contacting our customer services team on the contact details in section 18.

7.6. We will make reimbursement no later than 14 days after the day we receive a clear statement of cancellation.

7.7. You may also cancel your contract if the products provided in the services are damaged, faulty, or not as described. Please see clause 10 for further information.

8. Rental products and other services for both Fonden Roskilde Festival and Fonden Roskilde Festival Partner Volt ApS

8.1. Rented products must be returned no later than at the end of the rental period. The rental period is stated in the product description of each rental product.

8.2. The rented products must be returned at the same place you picked up the rented products.

8.3. You lose your right to your deposit if the rented product is handed back to us in an unusable state, thereby meaning that the product can’t be rented out again on the same terms as you rented the product, or not returned at all.

9. How do I change, cancel, or return an order?

9.1. It is not possible to make changes to your order once you have placed it. If you would like to place products to your order, please place a new order for these products.

If you need to remove products from your order or cancel it completely, please contact our customer service team using the following contact details:info@roskilde-festival.dk.

Order returns can happen at the same place you picked up your order and incurs no additional charge. That option is not available after the event Roskilde Festival 2022 has concluded. Please note that we do not refund costs associated with return delivery (see section 4.01.6 and 6.01.6).

10. What if the products are damaged or faulty?

10.1. If your order arrives and the products are damaged, faulty, or not as described, you may invoke the right to cancel the order and we will reimburse you the cost of the product.  We will reimburse you the cost through the payment method you used to place the order within 14 days of our receipt of the returned product(s).

10.2. Please note that the right to cancellation does not apply if the damage or faultiness of the product is due to wear and tear, incorrect use (for example in violation of instructions for use). In these circumstances you bear the costs of examining the product and possibly any reparation or replacement of the product that may take place.

10.3. The Danish Sales of Goods Act’s rules on the lack of conformity of products can be applicable.

11. When will the order be delivered?

11.1. Delivery dates can vary depending on the availability of the product, rental product, and other services. An estimated delivery date will appear at checkout.

12. Our rights to vary these Terms and Conditions

12.1. We reserve the right to change these Terms and Conditions from time to time, but any changes to the Terms and Conditions will not apply to any orders that we have accepted prior to the change being made.

12.2. These Terms and Conditions govern our relationship with you. Any changes to the Terms and Conditions governing existing contracts must be in writing and signed by both parties. In this way, we can avoid any problems surrounding what we and you are expected to do.

13. How we may use your personal information

13.1. Fonden Roskilde Festival and Fonden Roskilde Festival Partner Volt ApS will only use your personal information as set out in our Privacy Policy.

14. Alternative Dispute Resolution

14.1. Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not content with how we have handled any complaint, you may want to contact the alternative dispute resolution provider we use.

14.2. If your country of residence is within Denmark, if you are not happy with how we have handled any complaint, you may submit a complaint via the Danish Appeals Boards Authority’s (“Nævnenes Hus”) platform at www.naevneneshus.dk.

14.3. If your country of residence is within the EU, if you are not happy with how we have handled any complaint, you may submit a complaint via the European Commission Online Dispute Resolution platform at www.ec.europa.eu/odr. 

15. If a court finds part of this contract unenforceable, the rest will continue in force

15.1. If any part of these Terms and Conditions shall be found by a Court to be unlawful, void, or unenforceable for any reason, then that provision shall be capable of being severed and separated from these Terms and Conditions and shall not affect the validity and enforceability of any of the other provisions of these Terms and Conditions which shall remain in force.

16. Even if we delay in enforcing this contract, we can still enforce it later

16.1. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of you breaking this contract, that will not mean that you do not have to do those things and it will not prevent us from taking steps against you at a later date. For example, if you miss a payment and we do not chase you, but we continue to provide the products and-/or services, we can still require you to make the payment at a later date.

17. Which laws apply to this contract and where may you bring legal proceedings?

17.1. These Terms and Conditions shall be subject to Danish law. All claims or disputes arising in relation to or in connection with any contract entered with Fonden Roskilde Festival under these Terms and Conditions shall be governed by Danish law.

19.1. By using our site and other sites managed by Fonden Roskilde Festival, you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms, you must not use our site.

21. We may make changes to these terms

22. We may make changes to our site

22.1. We may update and change our site, and other sites managed by Fonden Roskilde Festival, from time to time to reflect changes to our products, our user’s needs, and our business priorities.

23. We may suspend or withdraw our site

23.1. Our site is made available free of charge.

23.2. We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational or other reasons. We will try to give you reasonable notice of any suspension or withdrawal.

24. You must keep your account details safe

24.1. If you choose, or are provided with, a user identification code, password, or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

24.2. We reserve the right to disable any user identification code or password whether chosen by you or allocated by us, at any time, if in our reasonable opinion, you have failed to comply with any of the provisions of these terms of use.

25. Communications

25.1. We will send you information relating to your order (e.g., payment authorizations, invoices, changes in password or payment method, confirmation messages, notices) in electronic form only, for example via emails to your email address provided during registration or during placement of order.

26. How you may use material on our site

26.1. Fonden Roskilde Festival is the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyrights laws and treaties around the world. All such rights are reserved.

26.2. You may print off one copy, and may download extracts, of any page(s) from our site for your personal use.

26.3. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

26.4. Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.

26.5. You must not use any part of the content on our site for commercial purposes without obtaining a license to do so from us or our licensors.

26.6. If you print off, copy, or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you will automatically terminate your right to use and access our site and may subject you to legal liability.

27. We are not responsible for websites we link to

27.1. Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by Fonden Roskilde Festival or Fonden Roskilde Festival Partner Volt ApS of those linked sites or information you may obtain from them. We have no control over the contents of those sites or resources.

28. Our responsibility for loss or damage suffered by you

28.1. We will be responsible to you for any foreseeable loss and damage caused by us. If we fail to comply with these Terms and Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of Fonden Roskilde Festival or Fonden Roskilde Festival Partner Volt ApS or failing to use reasonable care and skill. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both of us knew it might happen.

28.2. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors, for fraud or fraudulent misrepresentation or for breach of your legal rights in relation to the products.

28.3. Your use of the website is at your own sole risk. To the fullest extent permitted by law, you are responsible for complying with these Terms and Conditions and all applicable laws with respect to the use of the website.

28.4. We are not liable in any event for your failure to comply to provide us with accurate information, including but not limited to, shipping address, billing address, payment details or email address.

29. We are not responsible for viruses, and you must not introduce them

29.1. We do not guarantee that our site will be secure or free from bugs or viruses.

29.2. You are responsible for configuring your information technology, computer programmes, and platform access to our site. You should use your own virus protection program.

29.3. You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorized access to our site, the server on which our site Is stored, or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Danish Penal Code. We will report any such breach to the relevant law enforcement authorities, and we will co-operate with those authorities. In the event of such breach, your right to use our site will cease immediately.

30. Rules about linking to our site

30.1. You must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part where none exists.
